Terms and Conditions of Sale

These terms apply to every order placed on the UK section of www.btob.email (prices in pounds sterling). Please read them before you order. Nothing in these terms affects your statutory rights as a consumer.

1. About us

www.btob.email is operated by CAPTAIN LEGAL LLC, a limited liability company (LLC) organised under US law, whose address is 30 N Gould St, Ste R, Sheridan, WY 82801, USA. You can contact us via our contact form.

In these terms, "we", "us" and "our" mean CAPTAIN LEGAL LLC; "you" means the customer.

2. Definitions

  • Consumer: an individual acting for purposes wholly or mainly outside their trade, business, craft or profession.
  • Business customer: a customer acting for the purposes of their trade, business, craft or profession.
  • Files: the downloadable data files offered on the site, such as business contact files by activity or sector (including real estate), public sector files and files prepared on request.

3. Our files

3.1 Each product page describes the file before you order: area, category, columns, number of records and number of email addresses and phone numbers. These figures describe the file when it was published. Contact details change over time: some may no longer be valid when you use them, and not every record contains every field.

3.2 Files are supplied in CSV and XLSX (Excel) formats, unless the product page says otherwise.

4. Prices and payment

4.1 Prices are shown in pounds sterling (GBP). The price you pay is the total shown at checkout.

4.2 Payment is taken in full when you order, through PayPal, using a PayPal account or a payment card via PayPal. We never receive or store your card details.

4.3 We may change our prices at any time. A change does not affect orders already placed.

5. How the contract is formed

5.1 To order, you choose a file, enter the email address for delivery, check the order summary, accept these terms (and, if you are a consumer, give the consent and acknowledgement described in section 7), then pay with PayPal.

5.2 The contract is formed when PayPal confirms your payment. We then send you an order confirmation by email.

6. Delivery

6.1 Files are digital content delivered online. As soon as your payment is confirmed, a download link appears on screen and the same link is sent to the email address you entered. There is no customer account.

6.2 Please check that your email address is correct. If you have trouble downloading your file, contact us via our contact form.

7. Your right to cancel (consumers)

7.1 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers normally have 14 days to cancel a contract made at a distance.

7.2 Our files are digital content not supplied on a tangible medium. Under regulation 37 of those Regulations, you lose your right to cancel once supply of the file has begun if, before payment, you gave your express consent for supply to begin during the cancellation period and acknowledged that you would lose your right to cancel, and this was confirmed to you in writing, for example in the order confirmation email.

7.3 If these conditions are not met, you may cancel within 14 days of the day the contract was made, without giving a reason. Tell us clearly, for example via our contact form. We will refund you within 14 days of being told, using the same payment method.

7.4 Business customers have no statutory right to cancel.

8. Licence and your obligations

8.1 Licence. We grant you a non-exclusive, non-transferable licence to use the files you buy for your own internal purposes. You must not resell, rent, transfer, publish or share any file, in whole or in part, whether free of charge or for payment, or use it to build a database for sale.

8.2 Your obligations. You are responsible for how you use the data and you act as an independent controller. In particular, you must comply with:

  • UK GDPR and the Data Protection Act 2018: have a lawful basis for your processing; tell people where you obtained their data and how to object, at the latest when you first contact them and in any case within one month (Article 14 UK GDPR); keep the data only as long as necessary and keep it secure.
  • The Privacy and Electronic Communications Regulations 2003 (PECR): marketing emails and text messages to individual subscribers, including sole traders and some partnerships, require their prior consent. Our files do not include this consent, and the "soft opt-in" never applies to data bought from us. Marketing emails to corporate subscribers (companies, LLPs, public bodies) do not need prior consent, but every message must identify you and offer a simple way to opt out.
  • Marketing calls: do not make live marketing calls to numbers registered with the Telephone Preference Service (TPS) or the Corporate Telephone Preference Service (CTPS), unless the person has specifically told you they agree to your calls. Do not make automated marketing calls without prior consent. Respect anyone who asks you not to call again.
  • Objections: act promptly on every objection or erasure request you receive, and do not contact people who objected again, including when you buy a new file.
  • Contacts outside the UK: comply with the rules of the country of the people you contact.

8.3 Business customers will indemnify us against third-party claims arising from use of the files in breach of this section.

9. Our responsibility to you

9.1 Consumers. Under the Consumer Rights Act 2015, digital content must be of satisfactory quality, fit for purpose and as described. If a file is faulty, for example it cannot be opened or it is not the file you ordered, contact us: you may be entitled to a repair or replacement, or to a price reduction or refund. We are responsible for foreseeable loss and damage caused by our breach of these terms or our failure to use reasonable care and skill.

9.2 Business customers. Our total liability for any order is limited to the price paid for that order. We are not liable for loss of profit, business or opportunity, or for any indirect or consequential loss.

9.3 Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded by law.

9.4 We do not guarantee any commercial result from using the files, such as open, reply or conversion rates.

10. Personal data

We process your personal data as described in our privacy policy. If you are listed in one of our files, the privacy policy also explains how to ask for access, object or ask for erasure.

11. Complaints and disputes

If you have a complaint, contact us via our contact form. If you are a consumer living in the UK, you keep the protection of the mandatory rules of the law of the part of the UK where you live, and you may bring proceedings in your local courts.

12. Changes to these terms

We may update these terms. The version that applies to your order is the one shown on the site when you placed it.
